OEHHA recently published proposed rule changes that will eliminate short- form label use to provide clear and reasonable warnings to consumers. New short-form warnings will need to be tailored to each product and identify a specific chemical and the nature of the risk to be compliant with Prop 65 requirements. If implemented, the rules may require many businesses to make substantial changes to their short-form warnings before a two-year phase-in deadline.
OEHHA will hold a public hearing and webinar about these proposed changes on Wednesday, December 13, 2023, at Noon Central. To learn more about the proposed changes or to register to attend the public hearing in-person or via Zoom, go to https://oehha.ca.gov/proposition-65/crnr/public-hearing-information-proposed-amendments-regulations-clear-and-reasonable.
OEHHA’s proposed regulatory changes will end the widespread use of the short form warning label and may require testing of products by some businesses to ascertain chemical risks.
